If a product is listed at an obviously incorrect price (such as a $500 item listed for $5), we reserve the right to cancel the order and contact you to confirm the correct price before processing payment. Packaging, artwork, and product appearance may vary slightly from manufacturer to manufacturer or between production runs. Stock Availability

The availability of products on our website does not guarantee that items are in stock. We may limit quantities per customer or household for high-demand items to ensure fair distribution. Pre-Sale and Pre-Order Items

Pre-sale items are subject to manufacturer release dates, which are estimates and subject to change. Manufacturer delays are beyond our control. Once a pre-sale item is released by the manufacturer, we will ship your order within 5-8 business days. Pre-sale orders cannot be canceled or modified after payment is processed. If a manufacturer cancels a release entirely, you will receive a full refund.

Order Placement and Acceptance

Placing an Order

When you place an order on Marshul, you are making an offer to purchase products at the stated price. Submitting an order does not automatically constitute acceptance by Marshul. We reserve the right to accept or reject any order at our sole discretion.

Order Verification and Acceptance

We reserve the right to verify your identity, payment information, and shipping address before processing your order. We may contact you to confirm details or request additional information. We also reserve the right to refuse or cancel any order that appears fraudulent, suspicious, or in violation of these Terms or applicable law. If we cancel an order, we will provide a full refund of any payment received.

Order Confirmation

Once we accept your order, you will receive an order confirmation email containing your order number, items ordered, total price, and estimated delivery date. This confirmation indicates that we have accepted your order and will proceed with fulfillment.

Payment Terms and Methods

Marshul accepts the following payment methods: Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, Google Pay, and Shop Pay. All transactions are processed in U.S. Dollars (USD).

Payment Processing

Payment is collected at the time you place your order, including for pre-sale items. Your payment method will be charged the full order amount, including applicable taxes and shipping fees. If your payment fails or is declined, we will hold your order for 48 hours while attempting to process payment. If payment is not successfully processed within 48 hours, your order will be automatically canceled.

Authorization

By providing payment information, you authorize Marshul to charge your payment method for the order amount. You represent that you are authorized to use the payment method provided and that all information is accurate and complete.

Billing Disputes

If you believe there has been an error in billing or an unauthorized charge, please contact us immediately at contact@marshul.com. We will investigate and work to resolve any billing disputes promptly.

Authenticity Guarantee

Marshul guarantees that all products sold on our website are authentic and sourced from authorized distributors and manufacturers. We work directly with manufacturers such as Panini, Topps, Upper Deck, and other authorized suppliers to ensure that all products are genuine and factory-sealed.

We have zero tolerance for counterfeit, unauthorized, or gray-market products. If you receive a product that you believe is not authentic, please contact us immediately with photos and details. We will investigate and provide a replacement or full refund at our discretion.

Intellectual Property Rights

All content on marshul.com, including but not limited to the website design, layout, logos, product photographs, product descriptions, text, graphics, and the Marshul brand name and trademarks, is the exclusive property of Marshul LLC and is protected by U.S. and international copyright, trademark, and intellectual property laws.

Sealed Products

Products sold as sealed are provided without warranty regarding their contents. We do not guarantee specific cards, autographs, hits, or insertion ratios. The contents of sealed products are determined by the manufacturer, and variations in pulls and hits are normal and expected in the hobby.

Limitation of Damages

To the fullest extent permitted by law, Marshul shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for lost profits, lost revenue, lost data, lost business opportunity, or loss of use, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or relating to these Terms or your use of Marshul shall not exceed the amount you paid for the product or service in question. If you have not made any purchase, our liability is limited to $100.

Exceptions

These limitations do not apply to liability that cannot be excluded or limited under applicable law, such as gross negligence, willful misconduct, or fraud.

Force Majeure

Marshul shall not be liable for any delay, failure, or inability to perform its obligations due to events beyond our reasonable control, including but not limited to:

These Terms and all matters relating to your use of Marshul shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Ector County, Texas.

By agreeing to these Terms, you consent to the exclusive jurisdiction of these courts and waive any objection to venue or inconvenient forum.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed. The remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Marshul regarding your use of our website and services. These Terms supersede all prior negotiations, understandings, and agreements, whether written or oral.
